If you wish to apply for a divorce in Gambia, the process involves filing a petition with the Regional Court in your area or through the Ministry of Justice. The procedure requires you to submit necessary documents, including proof of identity, marriage certificate, and other supporting evidence. Below is a comprehensive guide to help you understand the divorce application process in Gambia.

Procedure to Apply for Divorce in Gambia

  1. Consult a Lawyer:
Before applying for a divorce, it is recommended to consult with a lawyer to understand the process and prepare for the petition. The lawyer will assist in drafting the Petition for Divorce, which must be signed by the petitioner and sworn in before the court.
  2. Prepare and Submit Petition:
The lawyer will prepare the Petition for Divorce along with the relevant documents, including a Judicial Affidavit of proposed witnesses. The petition must also include details such as the grounds for divorce, property division, and child custody (if applicable).
  3. Publication of the Petition:
Once the petition is submitted, the court will order that the petition’s substance be published in a random newspaper for three weeks to ensure public notice.
  4. First Hearing and Notices:
After publication, the court will schedule the first hearing. Notices will be served to relevant parties, including the ex-spouse and government offices concerned.
  5. Witness Testimony:
The testimony of witnesses will be provided via a Judicial Affidavit, which speeds up the trial process. The witness will only need to affirm their affidavit in court.
  6. Formal Offer of Evidence:
After all evidence is presented, the lawyer will submit a Formal Offer of Evidence to the court for review.
  7. Court’s Decision:
If there is no opposition, the court will proceed to make a final decision on the divorce. Due to backlogs in court cases, the process may take several months to conclude.
  8. Final Decision and Decree:
After the court’s decision, the divorce will be granted, and a divorce certificate will be issued.

Required Documents for Divorce Application

To apply for a divorce, you will need to submit the following documents:

  1. Copy of Marriage Certificate.
  2. Proof of Identity (e.g., National ID card, Passport, Birth Certificate, or Driver’s License).
  3. Divorce Petition: A written petition that outlines the grounds for divorce, child custody details, and property issues.
  4. Evidence: If you are alleging fault grounds such as adultery or cruelty, supporting evidence must be provided.
  5. Property Inventory: A list of assets and property to be divided.
  6. Child Custody Plan (if applicable).
  7. Proof of Citizenship: A document confirming the citizenship status of the applicant.
