Whether you’re filing within your home country or abroad, understanding the proper steps, required documents, and potential costs can help make the process smoother. Below is a professional and easy-to-follow guide to filing for divorce, including both in-person and overseas applications.

Procedure: Applying for Divorce In-Person (Inside the Country)

  1. Consult a Lawyer:
    Begin by consulting a qualified lawyer who specializes in family law. The lawyer will guide you through the divorce process and legal requirements specific to your jurisdiction.
  2. Prepare the Petition:
    Your lawyer will draft a Petition for Divorce—a formal legal request to dissolve your marriage. This petition must be signed by your lawyer and sworn to by you as the Petitioner. Include all relevant documents and the Judicial Affidavit of proposed witnesses.
  3. Court Submission and Publication:
    Submit your petition to the Regional Trial Court. The court will order the substance of your petition to be published in a newspaper once a week for three consecutive weeks to notify concerned parties.
  4. Scheduling of Hearing:
    The court will calendar the case for the first hearing. Notices will be sent to the government offices concerned, the ex-spouse’s last known address, and any other relevant parties.
  5. Witness Testimony:
    Witnesses will provide their testimony via Judicial Affidavits—written statements of questions and answers that are notarized before the hearing. During the trial, the witness simply affirms this affidavit in court.
  6. Formal Offer of Evidence:
    Once all evidence has been presented, your lawyer will submit a Formal Offer of Evidence to the Regional Court.
  7. Court Decision:
    If there is no active opposition, you must wait for the court’s decision. Due to high caseloads, this may take several months. On average, a divorce trial can take around 18 months from the date of filing, though this varies based on circumstances.

Procedure: Applying for Divorce Abroad (Outside the Country)

  1. Contact the Embassy or Consulate:
    Approach the legal affairs office of your country’s embassy or consulate. Book an appointment in advance.
  2. Consultation and Legal Support:
    During your appointment, a consular officer will explain the process and provide details of a lawyer in that country. The lawyer will file the petition on your behalf if you’re residing abroad.
  3. Court Process:
    Similar to in-country applications, witness testimonies will be handled through Judicial Affidavits, evidence will be formally submitted, and the Regional Court will ultimately issue the divorce decision.

  • Copy of your Marriage Certificate.
  • Proof of identity (e.g., National ID, Birth Certificate, Passport, Driving License).
  • Divorce Petition detailing grounds for divorce, property, or custody matters.
  • Supporting evidence (e.g., witness statements, photographs, or documentation) if alleging fault grounds such as cruelty or adultery.
  • Property inventory if assets need division.
  • Child custody plan (if applicable).
  • Proof of citizenship.
